APPLICABLE LAW AND DISPUTES

All disputes shall be exclusively governed by and resolved in accordance with the laws of Hong Kong excluding any conflicts of law provisions. The 1980 United Nations Convention on Contracts for the International Sale of Goods, The United Nations Convention on the Limitation Period in the International Sale of Goods, and any implementations of any of the foregoing (or any legislation of a similar intention) in any applicable jurisdictions and any subsequent revisions thereto shall not apply to these Terms of Use.

By visiting NOQUACO.com, you agree that any dispute or claim relating to these Terms of Use shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted. The seat of arbitration shall be Hong Kong. The arbitration shall be conducted in English. Any award or determination of the arbitration tribunal shall be final, non-appealable, and conclusive upon the parties, and judgment thereon may be entered by any court of competent jurisdiction.

If any arbitration or other legal action is initiated by either of the parties, the prevailing party shall be entitled to recover from the other party reasonable attorneys’ fees and arbitration costs in addition to any other relief that may be awarded.
